Below, the rental conditions as well as the data protection instructions for Web and App are explained. The following English translation is for the convenience of our customers only and is not binding. The German version is authoritative.


 

 

Rental conditions and terms of use


smide is operated by smide KmG, based in Uster ZH (Switzerland).

smide KmG can terminate the operation of the E-Bike Sharing at any time. It will reimburse any prepaid credit balance in case of termination.

 

Liability

Neither the smide service team nor the limited commercial partnership smide KmG is accountable for the integrity of the content, the completeness of the content, accuracy, topicality nor the reliability of the e-bike offer.

The smide service team and smide KmG reject any responsibility for violations against the road traffic regulations. The use of the e-bikes is at the users own risk and the user is responsible for the personal accident and liability insurance. The police will report any traffic violations to the smide service team. The smide service team will provide the police with the name and address of the respective customer and charge the customer a fee for these expenses. The customer shall be responsible for any costs associated with the proceedings (costs of representation, legal costs, fines, etc.) 

The customer is not liable for theft, misappropriation or damage of the e-bike, as long as no wrongdoing can be attributed to the respective customer. Wrongdoing can be attributed to the customer, if the proper anti-theft-protection has been omitted (by ending the booking on the app) or if the e-bike was handled carelessly. In case of theft, the customer is obliged to report the incident to the smide service team immediately and to file a complaint with the police. In the event of theft, any payments will only be processed in the aftermath and in addition to any other existing theft insurance policies (household insurance, individual property insurance, etc.).

smide KmG acknowledges the presence of the compulsory liability insurance for personal injury and damage to property for the provided e-bikes. smide KmG underlines that the liability insurer can have recourse to the user in case of negligent actions (e. g. risky driving style, disregard of the road traffic regulations etc.) to the extent permitted by law.


GPS and usage data, data security

The e-bikes are equipped with a GPS tracking system. The GPS data as well as the usage data are stored and can be evaluated by the smide service team, smide KmG or a third party. Any data will be processed in accordance with Swiss data protection laws. Personalized evaluations are not created. In case of theft, GPS data is used to track the e-bike in real time.
